Thank you for considering doing business with The Perth Mortgage Specialist. This Credit Guide is designed to assist you in deciding whether to use the services we offer.

We are a representative of a licensed provider of credit assistance under the National Consumer Credit Protection Act 2009 (NCCP Act). The NCCP Act regulates the activity of lending, leasing and finance broking. This document provides you with information about us, our Licensee with whom you are dealing and the services we provide.

If you are looking for consumer credit products, our role is to help you find a product that suits you. That process involves talking to you to understand your requirements and objectives in seeking credit, as well as understanding your financial position.

Our Best Interests Duty (BID) obligations to you

The Best Interest Duty (BID) for mortgage brokers came into effect on 1st January 2021.

The BID and related obligations ensure that you receive advice that meets your objectives, financial situation and needs, and that we act in your best interests when providing this advice.

The law requires us to:

  1. Act in your best interests when providing credit assistance.
  2. Give you priority where a conflict of interest is identified when providing credit assistance.
  3. Not accept conflicted remuneration.

As a mortgage broker, we MUST act in your best interests when providing credit assistance whereas a lender has NO legal obligation to do so.

Our Responsible Lending Obligations to you

By law, before entering into a specific credit contract, we are obliged to conduct a Preliminary Credit Assessment to determine what kind of loans would be suitable for you. In consultation with you, we will explore and discuss with you your financial situation, financial objectives and borrowing needs before we determine which loan product may suit your requirements.

For the purposes of the Preliminary Credit Assessment, we will need to ask you some questions in order to assess whether the loan or lease is not unsuitable. The law requires us to

  • Make reasonable inquiries about your requirements and objectives
  • Make reasonable inquiries about your financial situation
  • Take reasonable steps to verify that financial situation

Credit will be unsuitable for you if, at the time of the assessment, it is likely that the following would apply at the time credit is provided:

  • You could not pay or could only pay with substantial hardship
  • The credit will not meet your requirements or objectives.

The assessment will be conducted prior to the recommendation of a particular product. The assessment will involve the collection and verification of financial information to determine the appropriate loan amount and the loan costs associated with entering a credit contract. This will ensure that your circumstances will be assessed appropriately and that the options suggested will not place you in financial hardship. Once completed, this Preliminary Credit Assessment is only valid for 90 days. A copy of the Preliminary Credit Assessment will be available to you, on request - this will be available up to 7 years after we provide you with credit assistance

Prior to the Preliminary Credit Assessment being conducted, we may provide you with Product summaries that highlight various key features and benefits of the product. We may also provide you with Product Comparison documents that allow you to compare products.

How do our Credit Representatives get paid?

Our Credit Representatives are paid a commission directly from the lender. The lender may pay them a percentage amount upon settlement of your loan and may also pay them an ongoing percentage amount for the life of your loan.

These amounts are paid to the Credit Representative by the lender and ARE NOT payable by you. If you are interested and want an estimate of what the commission payment will be and how it is worked out, please just ask us or our Credit Representative and we will be only too glad to provide you with this information.

We know there are times when you may wish to compliment us on something we have done well and other times when you may wish to tell us we have not met your expectations.

If for any reason, you do not feel that you have received the highest standard of care from us, we encourage you to share this with us. We have developed a process that we believe makes it easy for you to tell us of your concerns and for them to be addressed quickly and fairly.

If you choose to contact us by mail or email, please make sure you provide as much detail as possible about your complaint.

We will try to deal with your complaint on the spot. However, if this is not possible, we will write to you to acknowledge your complaint within 24 hours of receipt. We will ensure we treat you fairly and will work to resolve your complaint as soon as possible. In the rare event, we are still investigating your complaint after 30 days we will write to you to explain why and to let you know when we expect to have completed our investigation.

When we have completed our investigation, we will write to let you know the outcome and the reasons for our decision.

Taking it further
We hope that you will be satisfied with how we deal with your complaint. However, if your concerns remain unresolved, or you have not heard from us within 45 days, then you can have your complaint heard by our external disputes resolution scheme, Australian Financial Complaints Authority, an independent party.
